To be an authorized affiliate of MyDivorcePapers.com, you agree to abide by the terms and conditions contained in this agreement.

Please read this agreement carefully before registering and using the YOUR SITE NAME service as an affiliate. By signing up for the MyDivorcePapers.com affiliate program, you indicate your acceptance of this agreement and its terms and conditions.

Terms of Service

By filling out the signup form you acknowledge that you have read the terms and conditions, understand, and agree with them.
1. Joining the Program
By filling out the signup form you will automatically become an affiliate and are bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise our website to receive a commission on products purchased by your referral individuals. 
2. Revocation of Affiliate Status
Your affiliate application and status in the program may be suspended or terminated for any of the following reasons:

Inappropriate advertisements (False claims, misleading hyperlinks)
Spamming (mass email, mass newsgroup posting, etc...)
Advertising on sites containing/promoting illegal activities
Violation of intellectual property rights.
Posting any notice that says you do not recommend the business or that the business is shown in any manner as not being a good business to work with.  As an affiliate, if you post any notice that you do not recommend the business or a negative review you will not be paid any commission on any sale that comes from a negative review.  you also agree to forfeit any commissions owed for such actions.

3. Affiliate Links
You may use graphic and text links both on your website and in emails. The site may also be advertised "offline" in classified ads, magazines, and newpapers. You may use the graphics and text provided to you by us, or you may create your own as long as they are deemed appropriate according to the conditions in 2.

4. Affiliate Tracking
When a web surfer clicks through your affiliate link, a cookie is set in their browser that contains your affiliate username. Also, their IP address is tracked in the database along with your affiliate name. When this person decides to buy a product, the script will look for this cookie and/or try to match their IP address to identify the affiliate who will be awarded the commission. Visitors sent through your affiliate link may make a purchase later in time and the commission will still be awarded if the cookie is present in their browser and/or the are using the same IP address as the one logged in the database.

5. Terms of the agreement
These terms will begin upon your signup with the affiliate program and will end when your affiliate account is terminated. The terms of this agreement may be modified by us at any time. If any modification to the terms is unacceptable to you, your only choice is to terminate your affiliate account. Your continuing participation in the program will constitute your acceptance of any change.

6. Signup Bonuses / Credits 
Upon signing up with our program, you may or may not receive signup bonuses or credits to your affiliate account. These can amount to some form of cash equivalent. These signup bonuses or credits will only be paid out when you have reached the minimum payout amount designated by our Affiliate Program. You cannot redeem these credits for anything else other than what they are, and will not be dispersed until you have generated enough commissions that is equal or greater than the minimum payout amount. If you do not generate any commissions at all within a period of 1 year, our company reserves the right to revoke and cancel any signup bonuses credited to your affiliate account due to a lack of performance.

7. Liability
We will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of "intents of harm" to the program or our website. We do not make any expressed or implied warranties with respect to the affiliate program and/or products sold at this site. We make no claim that the operation of the affiliate program and our website will be error-free and we will not be liable for any interruptions or errors.

CAN-SPAM Rules and Acceptance

Compliance with CAN SPAM ACT
            Affiliate will fully comply with all requirements of the CAN SPAM ACT in every email it drops containing offers from the MyDivorcePapers.com network.
            Without limiting the generality of this compliance requirement, Affiliates are specifically advised of the following:
            a.  Email shall not contain a false or misleading domain name in the senders address or anywhere else in the message header.  All domain names used in message headers must be properly registered by the Affiliate with accurate contact information used in the registration.
            b.  Email shall not contain a non functioning IP address.  All IP addresses used in connection with sending email containing an offer from the MyDivorcePapers.com Network must be  valid and must be under the ownership/control of the sending party. 
            c.  Email shall not contain a falsified or deceptive subject line.  Every subject line must have a substantive relationship to the content of the email.  Any attempt to make an email appear as if it was in reply to a previous email or an email forwarded to the recipient by someone else is strictly prohibited.
            d.  Email shall not contain a false or deceptive alias or “from line”.  The from line must have a substantive relationship to the sender or the content of the email.  Use of from lines containing the name of any individual not directly employed by the Affiliate is prohibited without the express written consent of MyDivorcePapers.com.
            e. Every email shall contain a valid physical address of the Affiliate sending the email.  A post office box address is insufficient to comply with this requirement.
            f.  Every email shall contain a functioning return electronic mail address or other Internet-based mechanism, clearly and conspicuously displayed, that--
(i) a recipient may use to submit, in a manner specified in the message, a reply electronic mail message or other form of Internet-based communication requesting not to receive future commercial electronic mail messages from that sender at the electronic mail address where the message was received; and
(ii) remains capable of receiving such messages or communications for no less than 30 days after the transmission of the original message.
 
g.  Affiliate warrants that it honors unsubscribe/opt out requests within 5 days of original receipt.
 
h.  Email shall only be delivered to person’s who have provided prior affirmative consent to receive commercial email messages from the Affiliate. Use of harvested or culled data is strictly prohibited.
 
i.  To the extent that Affiliate uses any affiliate or other third party to deliver email containing commercial offers provided by MyDivorcePapers.com, Affiliate warrants that said affiliate or third party will act in full compliance with the CAN SPAM ACT and all other MyDivorcePapers.com Terms and Conditions.
 
j.  Affiliate agrees to fully indemnify and defend MyDivorcePapers.com against any claim brought against it for any violation of the CAN SPAM ACT that is the result of an email delivered by Affiliate or any affiliate or third party acting on behalf of Affiliate.
 
k.  In the event that MyDivorcePapers.com determines in its sole discretion that Affiliate has violated any provision of the CAN SPAM ACT or any other part of the MyDivorcePapers.com terms and conditions, MyDivorcePapers.com will terminate Affiliate’s account status immediately and without pay for all outstanding campaigns.  In the event that MyDivorcePapers.com takes such action, Affiliate may obtain a written explanation of the reasons behind the cancellation if explanation is requested from MyDivorcePapers.com within 48 hours of notification of cancellation.  Explanation shall be provided within 5 business days.
